Terms and Conditions and Privacy Policy

  3. These Terms of Service, together with Privacy Policy, and, if applicable, the

  5. invoice, form the main contract for the rental or use of our software. This
  6.  
  7. document applies to the use of extensions products and services, and
  8.  
  9. governs the manner in which extensions collects, uses, maintains and
  10.  
  11. discloses information collected from users (each, a "User"). This document
  12.  
  13. applies to the Chrome extension itself and all products and services offered by
  14.  
  15. extensions.
  16.  
  17. Preamble
  18. The following definitions shall apply:
  19.  
  20. GTC – this document
  21.  
  22. End device – any hardware used to play, install, run, compile, decompile,
  23.  
  24. and/or use software, of any type, mobility or hardware and/or software
  25.  
  26. environment
  27.  
  28. You, Your, Yourself – the contractual partner as the User (“Users” in plural) of
  29.  
  30. the services
  31.  
  32. (1) The GTCs apply to all deliverables we offer to users in connection with the
  33.  
  34. services, in particular the free and fee-based services. The GTCs cover the
  35.  
  36. browser add-ons, the applications, ads and web page serving, as well as all
  37.  
  38. additional services or software products in connection with the extensions.
  39.  
  40. (2) Deviations from these GTCs are considered agreed, if You continue to use
  41.  
  42. the extensions on a free basis. In particular, the mere omission of an objection
  43.  
  44. on our part to other terms and conditions does result in such terms and
  45.  
  46. conditions being considered as agreed.
  47.  
  48. (3) Specific rules on the use of a service may additionally apply. These
  49.  
  50. provisions are part of these GTCs between us and Yourself.
  51.  
  52. (4) We are not responsible for any inpage content, commercials, proxy,
  53.  
  54. redirects, video players, browsers, email clients and other internet services
  55.  
  56. made available by third parties, which you access with the help of our
  57.  
  58. services. This applies also to social networks. For such third-party internet
  59.  
  60. services, the terms of use of the corresponding website operator, advertiser or
  61.  
  62. social network provider apply.
  63.  
  64. Contract Conclusion
  65. (1) To use our services, you have to install the add-ons and/or a desktop or
  66.  
  67. mobile application and, possibly, register if asked to do so or, if applicable,
  68.  
  69. buy one of our products.
  70.  
  71. (2) The following descriptions of our products or services serve only as a
  72.  
  73. guide and we do not claim that they are complete or accurate. In particular,
  74.  
  75. they do not constitute a promise or guarantee of specifications.
  76.  
  77. (3) You are not required to create a user account in order to use extensions.
  78.  
  79. (4) Contract language is English. Even if we provide terms of use or a privacy
  80.  
  81. policy to you in other languages, the English version is solely decisive. Other
  82.  
  83. versions are provided only for convenience.
  84.  
  85. (5) Usage of the extension for commercial purposes and monetization by the
  86.  
  87. developer is generally permitted without your additional consent for all
  88.  
  89. products that we have designated as “Free” or “Based on free”.
  90.  
  91. (6) If you would like to use our service, these GTCs apply, and are included. If
  92.  
  93. you do not agree to these GTCs, please do not use our products or services.
  94.  
  95. (7) Minors are only permitted to use service functions, if their statutory
  96.  
  97. representative has explicitly approved such use.
  98.  
  99. (8) We reserve the right to restrict access to our products and services in
  100.  
  101. certain regions and/or states in full or in part. The availability of our extension
  102.  
  103. in the Google Chrome Store does not justify a claim to availability of the
  104.  
  105. products and/or services in your region and/or in your state
  106.  
  107. Personal Data
  108. I. Basis to Collect and use Personal and Non-Personal data
  109.  
  110. You’re obligated on your part to provide your Personal Data, when using any
  111.  
  112. product that we have designated as “Free” or “Based on free”. We have a
  113.  
  114. legitimate interest to collect and use it, namely so we can provide products or
  115.  
  116. services, or complete a transaction with you acc. to Article 6 subsection 1 lit.
  117.  
  118. b), f) GDPR.
  119.  
  120. II. Notion of Personal and Non-Personal data
  121.  
  122. Personal Data means any information concerning the personal or material
  123.  
  124. circumstances of an identified or identifiable individual such as name and age.
  125.  
  126. Non-personal data are all data that cannot be used to identify an individual,
  127.  
  128. such as statistics about usage of a website.
  129.  
  130. III. What Personal Data are collectedIP-Address: We do not differentiate
  131.  
  132. between static or dynamic IP addresses – that is driven at the user level.
  133.  
  134. However, we may use and transact your IP address without your additional
  135.  
  136. consent to third parties in order to provide our services.
  137.  
  138. Age: In order to comply with Children Protection Acts worldwide we require to
  139.  
  140. know your age from time to time.
  141.  
  142. IV. Collection of Non-Personal data
  143.  
  144. When you install the extension, or other our products, we start to collect on an
  145.  
  146. ongoing basis the following data:

  150. • Operating Systems
  151.  
  152. • Language

  154. • Location
  155.  
  156. • End device
  157.  
  158. When an installation, upgrade, or uninstallation occurs; whether the extension
  159.  
  160. or application is active, engaged, or logged-in by you (and associated
  161.  
  162. frequency), and other product-specific telemetry for basic actions or settings.
  163.  
  164. We also collect pings regarding attribution of our own internal marketing
  165.  
  166. efforts.
  167.  
  168. V. How Personal and Non-Personal Data are used
  169.  
  170. The use of the aforementioned personal and non-personal data is limited to:
  171.  
  172. (i) personalization and ensuring the best quality of our services (ii) for internal
  173.  
  174. analytical purposes such as accurately counting the number of browser
  175.  
  176. extension downloads, (iii) providing the services of the third-party services and
  177.  
  178. platforms, which may include sharing of the non-personal data with other our
  179.  
  180. products the you have installed, locally on your device, or (iv) surveying our
  181.  
  182. users from time to time.
  183.  
  184. We also collect pings regarding browser settings, such as whether Google
  185.  
  186. Chrome is set as the default browser, which search provider is set as the
  187.  
  188. default search option, number of add-ons, and other data.
  189.  
  190. VI. Data Processing abroad. If you are accessing or using GPP from the
  191.  
  192. U.S or other regions with laws governing data collection and use that may
  193.  
  194. differ from EU law, please note that you may be allowing the collection or
  195.  
  196. transferring of your personal data in or to the U.S. However, we have a strong
  197.  
  198. data privacy framework in place to ensure an adequate level of protection for
  199.  
  200. your Personal Data.

  202. VII. Changes to Privacy Policy

  204. We may occasionally change this Privacy Policy and when we do, we will also

  206. revise the “Effective Date” at the top of the Privacy Policy. Ultimately,

  221. information only and should not be relied upon or used as the sole basis for

  227. own risk. This extension, its page in the Google Chrome Store and our
  228.  
  229. website may contain certain historical information. Historical information,
  230.  
  231. necessarily, is not current and is provided for your reference only. We reserve

  233. the right to modify the contents of the extension and a website at any time, but
  234.  
  235. we have no obligation to send an update in writing. You agree that it is your
  236.  
  237. responsibility to monitor changes to our extension.

  239. Errors, Inaccuracies and Omissions
  240. Occasionally there may be information that contains typographical errors,
  241.  
  242. inaccuracies or omissions that may relate to product descriptions, pricing,
  243.  
  244. promotions, offers, product shipping charges, transit times and availability. We

  246. reserve the right to correct any errors, inaccuracies or omissions, and to

  353. (1) Generally, we DO NOT control what Internet services you retrieve or visit

  355. using our products and services. For this reason, we also do not assume any

  357. liability for your use of our products and services. However, it is possible that

  359. we are bound by law or other reasonable efforts to prevent access to certain
  360.  
  361. online content.

  363. (2) If statutory requirements are met, we always have the right to
  364.  
  365. extraordinary cancellation of the contract with the user with immediate effect.

  367. Availability of our Products and Services
  368. (1) The gratuitous use of our products and services is offered to users subject
  369.  
  370. to availability. We make an effort to ensure that the user is provided gratuitous
  371.  
  372. services without disruptions. Use may be limited or temporarily interrupted as
  373.  
  374. a result of maintenance work, further development or other disruptions. If this
  375.  
  376. is the case, it does not give rise to claims for damages against us.
  377.  
  378. (2) Furthermore, we have the right to change or discontinue the offered free
  379.  
  380. services and performance at any time at our own discretion without notice.
  381.  
  382. Fee-based services can be discontinued any time.
  383.  
  384. Our Liability
  385. (1) Our products and services protect your privacy in the scope indicated in
  386.  
  387. the corresponding specifications. For this purpose, we implement the
  388.  
  389. measures described in the specifications, the privacy policy and these GTCs.

  391. However, we cannot guarantee that third parties are unable to bypass these

  393. measures and your information is always absolutely protected from access by

  395. third parties.

  397. Technical Requirements
  398. (1) You need a computer with a Chrome web browser installed and with

  400. internet access to be able to use our services.
  401.  
  402. (2) The respective specifications for our products and services contain the

  404. corresponding hardware and software requirements that your system must
  405.  
  406. meet in order to be able to use the respective product. These are the minimal
  407.  
  408. conditions necessary to be able to offer the products and services in a stable
  409.  
  410. manner at all. However, a limited user experience (e.g. system slowdown)
  411.  
  412. may be associated with these minimal conditions. Therefore, we recommend
  413.  
  414. having a system configuration that exceeds our minimum requirements.

  416. (3) You are responsible for checking whether your system meets the technical
  417.  
  418. requirements in order to be able to use our services. We recommend that you
  419.  
  420. check this before ordering our fee-based services.

  422. (4) To be able to use our products and services, you ultimately need an

  424. internet connection. When installing and using our products and services, you
  425.  
  426. may incur transmission costs from the internet access provider that you use.
